Family law considerations can be complex for same-sex couples

| Jan 21, 2016 | Child Custody |

Dissolution of domestic partnerships can be complicated. Legal separation can also be complicated, but the family law legal process is available to help couples and families. Couples in same-sex marriages, domestic partnerships, or separation situations may be in need of understanding and direction. When same-sex couples seek to dissolve their marriages, as when any couples seeks a divorce, there are many important considerations both partners must resolve. Same-sex couples seeking to dissolve a domestic partnership may also have a number of important concerns with which they need to deal.

The traditional divorce process and the dissolution of a domestic partnership in California are similar, but there are also differences between the two. Similar issues such as property division, child custody and visitation, child support, and spousal support or alimony must be resolved between the couple.

Divorce-related issues can become increasingly complex in circumstances of same-sex marriages and domestic partnerships. Considerations such as legal and biological parentage can become of particular consequence, for instance, when determining child custody in same-sex marriage or domestic partnership situations. While domestic partners receive the same benefits and protections as married couples in California, they do not receive the same federal benefits and protections.

Because of the complexities associated with same-sex marriage, domestic partnerships, dissolutions, divorces and other types of relationship arrangements, it is important to understand the legal implications of entering each and how each type of relationship arrangement is ended. The family law legal process is designed to help couples in a variety of circumstances and alternative dispute resolution, such as mediation, or collaborative law options are also available to make the dissolution or divorce process as efficient and amicable as possible.

Those considering ending their domestic partnership or marriage may have a lot of questions. Oftentimes, addressing those concerns with an attorney is beneficial. Our law firm is skilled at handling family law matters, and we take pride in our ability to represent our clients’ best interests.
