Noncustodial parent abduction

Family law disputes are complicated and overwhelming for all those involved. This is further magnified in child custody cases where one parent is usually left disappointed. Their disappointment may lead them to try and abduct their own child in an attempt to spend more time with them. As heartbreaking as it is, it is against the law to take the child away from the custodial parent without prior notice. The law takes strict action against noncustodial parent abduction. The criminal justice system has methods to make sure the children are returned safely and such incidents do not happen again.

Kidnapping is a crime even if the perpetrator is the parent of the child. Law enforcement agencies come into play as soon as the abduction takes place. Federal and state authorities are informed about the situation. In case the noncustodial parent tries to move beyond state lines, the FBI could get involved.

In many cases, the noncustodial parent returns with the child after realizing that abducting their own child is not a good idea. Once the child is safely back home, the custodial parent could file a complaint in court and try to get the noncustodial parent’s rights revoked. The judge might revoke all their custodial rights to ensure it doesn’t happen again.
