Common considerations regarding child support in California

Child support is an important topic in the lives of many in Northern California, the East Bay and throughout the state. As a result, it is helpful for parents and families to be familiar with the basics of child support. To begin with, child support is determined by state child support guidelines. The calculation for child support can be complex but evaluates the number of children, the income of each of the parents, the amount of time each parent has custody and tax considerations.

In some circumstances the guidelines may be deviated from, however, there is a presumption that the child should enjoy the same lifestyle as its parents. In addition, California does not provide a cap for child support. Under the California Family Code, income from all sources is considered in the calculation of child support. This can include income earned from employment, recurring interest on investment income, the cash flow from a business and some other income sources.

The amount of child support paid does not include medical expenses that are not covered by insurance, extracurricular activities or school tuition. These may be paid in addition to child support. Child support generally ends when the child is 18 but if the child has not graduated from high school, it ends when the child graduates or turns 19 whichever takes place first. It is always important to keep in mind that child support may be modified due to a change in income or change in living arrangements, for instance.
