How Is Property Divided In California?

California is a “community property” state, which means that the courts will divide marital or “community” property in an equal 50/50 split. Even though this approach seems simple, there can be several wrinkles and complications in the division of assets and debts.

  • Characterizing property: The first critical stage in property division is determining which assets are “community” or marital property (and thus subject to division in divorce) and which assets are separate property. Complications arise with property that was acquired by either spouse before marriage, retirement and savings plans, business ownership assets, inheritances and settlements from civil litigation claims.
  • Valuating property: Once the assets are characterized, it is essential to determine their value before dividing them. I work with economic experts and appraisers when needed to obtain accurate values for my clients’ assets.
  • Dividing property: Although the California courts strive for a perfect 50/50 split of assets in a divorce, a great deal of knowledge and creativity are needed for dividing assets. I will work with you individually to help you come up with a property division agreement that will work for your situation.
  • Dividing debts: Debt division in California divorce is becoming an increasingly important and increasingly complicated area of practice. I will help you organize all of your marital debt, distinguish it from individual debt and create a plan for debt division.
